This Driver Independent Contractor Agreement (“Agreement”) is between you and LocalRun, a service operated by . You accept it in the driver app before your first shift. It matches the summary shown in the app. This is not legal advice — you may consult your own attorney or tax advisor before accepting.
1. Independent contractor status
- You are an independent contractor (1099), not an employee of LocalRun, , or the businesses you deliver for. You are not entitled to employee wages, overtime, benefits, unemployment, or workers’ compensation from LocalRun.
- You control your vehicle, phone, and route (within assignment rules), and you decide when to start or end a voluntary shift.
- Nothing in this Agreement or the app creates an attorney–client relationship with LocalRun or .
2. Shifts and assignments
- Starting a shift is a voluntary commitment to stay available with GPS on for at least 4 hours. End early only for emergencies, through LocalRun support. This is a marketplace participation rule, not payroll scheduling.
- LocalRun assigns the next nearby standard run to the nearest on-shift driver to the pickup. You don’t cherry-pick individual car orders. A run may include up to two nearby stops.
- Truck and trailer jobs are optional and never guaranteed — only take them if you opted in and your vehicle can handle them.
3. License, insurance, and background check
- You hold a valid driver’s license and active auto insurance that covers paid delivery driving in your state, including any commercial or delivery endorsement your insurer or state requires.
- You will upload license and insurance photos, complete a background check through LocalRun’s third-party provider, and finish Stripe payout and tax onboarding before shifts unlock.
- You will keep your license and insurance current and tell LocalRun if either lapses.
4. Pay and taxes
- For each completed delivery you earn base pay set by distance band (store to customer), plus a small bump on large orders. The current pay bands are shown in the driver app and on our Drive page, and may change with notice in the app.
- Customer tips are paid to you in full.
- Payouts are made through Stripe Connect to your own payout account. Stripe collects W-9 / tax ID information used to issue Form 1099-NEC when IRS thresholds are met.
- You are responsible for your own income and self-employment taxes, and for your vehicle, fuel, phone, and other costs.
5. Safety and conduct
- Follow traffic laws and safe food-handling practices while delivering. Never drive impaired or use your phone unsafely while driving.
- Treat customers, business staff, and other drivers with respect. Follow handoff instructions, including ID checks for age-restricted items.
- Do not collect cash or payment from customers; all payments go through LocalRun.
6. Location data
While you are on shift or on an active run, the driver app collects your GPS location to assign runs, show customers delivery progress, and log mileage. See the Privacy Policy.
7. Deactivation
LocalRun may pause or deactivate access for a failed background check, lapsed license or insurance, fraud, unsafe behavior, poor ratings, or repeated no-shows. You may stop driving at any time.
8. Insurance and liability
You are responsible for accidents, injuries, damage, and tickets that happen while you drive, to the extent allowed by law, and you agree to carry the insurance described above. To the fullest extent allowed by law, LocalRun is not liable for indirect or consequential damages.
9. General
This Agreement is governed by the laws of the State of Tennessee. LocalRun may update it by changing the “Last updated” date and asking you to accept the new version in the app. Also see the Terms of Service.
